CONSTITUTION OF NEW HAMPSHIRE STATE BOARD 32 IAABO
AND
DISTRICT BOARDS OF NEW HAMPSHIRE BOARD 32 IAABO
Article I Name and Territory
Section 1. The name of the State organization shall be the New Hampshire Board 32 of the International Association of Approved Basketball Officials (IAABO). The territory of the State Board shall include the entire State of New Hampshire.
Section 2. The name and territory of each District Board shall be:
a. Southeastern District Board 122 Rockingham and Strafford Counties, except the towns of Auburn, Candia, Deerfield, Derry and Londonderry.
b. Metro District Board 117 Hillsborough County, as well as the towns of Auburn, Candia, Deerfield, Derry, and Londonderry.
c. Southwestern District Board 128 Sullivan and Cheshire Counties, as well as the towns of Lebanon, West Lebanon and Hanover.
d. North Central District Board 118 Belknap, Carroll, Coos, Grafton and Merrimack Counties, except the towns of Lebanon, West Lebanon and Hanover.
A. General purposes of the State Board:
Section 1. To unite all approved and registered basketball officials in one State organization.
Section 2. To organize a State Board of approved basketball officials and as many District Boards as necessary.
Section 3. To study and improve the technique of basketball officiating.
Section 4. To promote the scheduling of interpretation meetings and clinics.
Section 5. To study the administration and revision of the official basketball rules, particularly from the standpoint of the official.
Section 6. To promote the uniform interpretation and administration of the official basketball rules by all officials throughout the entire State.
Section 7. To collaborate with the National Federation, the NCAA Basketball Rules Committees, the coaches associations, and other organizations in all matters pertaining to the advancement of basketball as a wholesome form of recreation.
Section 8. To emphasize basketball as a great game for the development of character, good sportsmanship and citizenship.
Section 9. To act as a liaison between each District Board and the New Hampshire Interscholastic Athletic Association, the International Association of Approved Basketball Officials, and every other District Board in New Hampshire.
Section 10. To resolve all conflicts between the District Boards within Board 32.
Section 1. The publication of a State Directory in a form available to every official.
Section 2. To oversee the John Burke Sportsmanship Award program.
Section 3. To provide an annual interpretation to each District Board.
Section 4. To establish and maintain a liaison with the NHIAA.
Section 5. To elect and oversee a State Supervisor of Officials.
Section 6. To establish a right of appeal for officials who have been disciplined.
C. Purposes of the District Boards
Section 1. To unite all approved and registered basketball officials in a geographical district within the State of New Hampshire.
Section 2. To promote the uniform interpretation and administration of the official basketball rules by all officials throughout the district in accordance with the guidelines, and under the general supervision, of the State Board.
Section 3. To promote the holding of clinics, interpretations and meetings in order to improve the quality of basketball officiating.
Section 1. The State Board includes all members of each District Board. The Executive Board shall only include the three elected representatives from each of the four District Boards, the Immediate Past President, the President, the President-Elect, the Secretary-Treasurer, the Interpreter, the Assigner, the Supervisor of Officials, and the Legal Adviser. The Executive Board shall conduct the specific business of the State Board. Only members of the Executive Board may vote on matters specifically related to the State Board. Only those members of the Executive Board who are physically present shall be allowed to vote. Each voting member of the Executive Board has the right to vote, even if the vote is being taken on a position that member seeks to fill. The Legal Adviser will be the only member of the Executive Board who is a non-voting member.
Section 2. Each District Board of approved basketball officials shall be recognized by the State Board upon the issuance of a Constitution and By-Laws. The District Boards and all members thereof shall remain in good standing so long as all annual dues are paid and all names are listed on the official roster of the appropriate District Board.
Section 3. Individual residents within the territory of a chartered District Board shall be accepted into membership after they have satisfactorily passed the International, the State, and the District Board requirements, and have paid their registration fee. They shall continue in good standing so long as all dues are paid, their names are listed on the official roster of their District Board and they have met all other requirements of their District Board. All approved and registered basketball officials residing within the geographical boundaries of each district established by the State Board shall be eligible for membership in that District Board.
Section 4. Each District Board shall classify its members as active, provisional, associate, inactive, retired, and/or life, in accordance with IAABO regulations.
Section 5. Dual members shall be recognized, and classified as active, probationary, associate, inactive, retired, and/or life, provided; (a) they are a member in good standing in the IAABO Board where they reside, (b) they are rated to work high school varsity contests, (c) they pay the fees required by the District Board nearest their residence, unless that District Board approves otherwise, (d) and they meet all the attendance requirements, regarding interpretations and business meetings, of the District Board nearest their residence.
Section 6. Any active member who wishes to become inactive and still retain membership may request to become an associate or retired member. The dues for such members shall be, at a minimum, the cost of registration with the International office. Additional fees maybe established by each District Board. An associate or retired member may only become an active member again by meeting the procedures established by the District Board for new members.
Section 7. Only Board 32 members registered with the New Hampshire Interscholastic Athletic Association will be eligible to officiate NHIAA high school varsity basketball games.
Section 1. The dues for membership shall be set by each District Board, subject to review and approval by the State Board.
Section 1. The President and the Secretary-Treasurer shall present a budget for consideration at each annual spring meeting.
Section 2. All State Board expenses for the approved budget shall be assessed to each District Board based on each District Board's percentage of the total active membership of the State Board.
Section 3. The fiscal year of the State Board shall be from May 1 to April 30 each year.
A. New Hampshire State Board and Duties
Section 1. The officers of the Executive Board of the State Board shall be the:
a. Immediate Past President
b. President
c. President-Elect
d. Secretary-Treasurer
e. Interpreter
f. Supervisor of Officials
g. Assigner
h. Legal Adviser
Section 2. The term of the Secretary-Treasurer and of the Supervisor of Officials will each be for three years. The President is not elected, since that position is assumed by the President-Elect, who is elected for a two year term. The Interpreter is elected for a three year term. The President will serve a two year term. The Assigner is appointed for a three year term by the Executive Board. The Legal Adviser shall be appointed by the Executive Board and shall serve an indefinite term at the pleasure of the Executive Board.
Section 3. The election of officers shall take place at the annual meeting of the State Board, and newly elected officers shall take office immediately upon election. The presidency shall be rotated among each of the District Boards. No District Board member shall become the President until each other District Board has filled that position.
Section 4 Duties of Officers
a. The President:
(1) Shall call to order and preside over all meetings of the Executive Board.
(2) Shall appoint such committees as are authorized by the Executive Board.
(3) Shall, with the advice and consent of the Executive Board, schedule such meetings of the Executive Board as are needed to conduct the business of the State Board.
(4) Shall, at the conclusion of his/her term of office, serve as a member of the Executive Board until such time as he/she is replaced by the outgoing President.
(5) Shall take any independent action he/she believes to be in the best interests of the State Board.
b. The President-Elect, in the absence of the President, shall perform the President's duties.
c. In the event both of the above named officers are absent, the President's duties shall be assumed in the following order of succession:
the Secretary-Treasurer, the Interpreter and thereafter by seniority of on the Executive Board.
d. The Secretary-Treasurer shall keep an accurate record of the proceedings of the Executive Board. He/she shall be the Treasurer of the State Board and in this capacity shall keep a full and accurate accounting of all monies received. He/she shall also deposit the same in the name of, and to the credit of, the New Hampshire State Board of Approved Basketball Officials. He/she shall disburse all monies and shall present, at each annual meeting, a written report of the treasury. He/she shall arrange for an annual audit of the accounts by the Executive Board, if so requested. The Secretary-Treasurer shall be bonded for five thousand dollars annually.
e. The Interpreter shall attend the Fall International Interpretation Conference held each year by the International organization. He/she personally, or through any designee, shall educate officials, coaches and players in the interpretation of rules, the uniformity of mechanics and the techniques of good officiating. He/she shall present the first official annual basketball rules interpretation and mechanics session to each District Board before the basketball season begins.
f. The Secretary-Treasurer and the President may attend the Annual Spring Meeting of IAABO as Board 32 Representatives. Alternates may be appointed by the President if necessary. All reasonable costs incurred shall be reimbursed by the State Board.
g. The Supervisor of Officials shall be a member of each NHIAA Committee to which he/she is appointed. The interests of Board 32 members shall be upheld, first and foremost, by the Supervisor. The Supervisor shall meet with the NHIAA Sports Officiating Committee, whenever invited, to represent the interests of Board 32 and its District Boards.
h. The Assigner shall be subject to the criteria the Executive Board establishes for that position.
Section 5. Ongoing and Special Obligations
a. Ongoing obligations of the State Board:
(1) The Executive Board shall select both a male and a female High School Athlete who each best exemplified the values of sportsmanship and fair play during the basketball season. Nominations for this John Burke Award are to be requested from all members of the State and District Boards. The selections shall take place at the spring meeting.
(2) A State Apprentice Coordinator may be appointed by the State President to seek to provide basic uniformity within the State and each District. Each District Board may establish their own guidelines and/or program.
b. Special Committees may be established as needed from time to time, by the President, State Board and/or the District Boards, as the case may be. Each District Board may establish its own special committees for matters related specifically to that District Board, without approval by the State Board. In any case each special committee will be provided a specific charge and, at the completion of that charge, the committee will be dissolved without further action being required.
B. District Board Officers and Duties
Section 1. The Officers of each District Board shall be elected by the members of that District, and they may include the following positions:
a. President
b. President-Elect
c. Secretary-Treasurer
d. Interpreter
e. 3 representatives to the State Board
f. Any other officers, as determined by each District Board
Section 2. The length of term of each Officer shall be determined by each District Board.
Section 3. Date of term of office each year shall be from the time of election at the annual business meeting.
Section 4. Duties of Officers:
The duties for the District Board Officers are similar to those outlined for the State Board Officers, with the following stipulations:
a. If a member from a particular District Board is in line to become President of Board 32, but that person chooses not to become President of Board 32, the Executive Committee of that District Board shall pick the person who it wants to become President of Board 32.
b. Each District Board Secretary-Treasurer will conduct the business of his/her District Board. He/she shall forward all appropriate records and monies as are necessary and required by the State Secretary-Treasurer for registration with the NHIAA and with IAABO. Such transactions will take place in a timely fashion, consistent with a schedule to be established by the State Secretary-Treasurer, and approved by the State Executive Board. However, in no case will the final deadline be later than April 1 of each year without specific approval, in advance, by the State Executive Board.
c. Each District Board Interpreter will meet with, work with and be under the supervision of the State Interpreter, pursuant to policies established by the State Executive Board.
d. The Secretary-Treasurer and the President of each District Board may attend the Annual Meeting of IAABO as delegates of that respective District Board. Alternates may be appointed by the District Board President, if necessary.
Section 5. Meetings
a. Each District Board will establish policies relative to attendance at meetings of that District Board, provided they are in accordance with policies established by State Board 32 IAABO and IAABO.
b. Each District Board will conduct at least one meeting each year for the purpose of conducting the business of the District Board. This meeting shall address the election of officers and representative to the State Board.
c. The State Board shall conduct at least one meeting each year for the purpose of conducting the business of the State Board. The election of officers shall take place at a meeting held no later than May 1 of each calendar year. This particular meeting shall be the spring meeting.
d. A quorum shall consist of at least one half of the members of each District Board and shall be necessary in order to conduct business of that District Board. A quorum of eight (8) shall be required for the State Executive Board to conduct the business of that Board.
This Constitution may be amended by a two-thirds vote of the duly accredited members present at any regularly scheduled meeting, or at any special meeting called for that purpose, provided, in the latter case, that written notice of the proposed amendment shall have been sent to all members at least fifteen days prior to the meeting. Amendments shall not in any way be in conflict with the Constitution and By-Laws of IAABO.
Article 1 Membership
Section 1. Membership. Applicants for active membership shall indicate their desire to join to the Chairman of the District Apprentice Program of the District Board which has jurisdiction over the territory in which the applicant resides. In addition, each applicant shall successively meet the requirements established by the District Board, the State Board 32 and the International Association of Approved Basketball Officials.
Section 2. Terms of Membership. As long as each member remains in good standing, he/she shall be entitled to the rights and privileges of membership, and shall be bound by the Constitution and By-Laws of the District Board, and of State Board 32.
Section 3. District Boards shall agree on the placement of dual members who reside in a territory not covered by the New Hampshire State Board. In the absence of such an agreement, any such decision shall be made by State Board 32.
Section 1. Acceptance of transfer. If a member of a District Board changes his/her residence to the jurisdiction of another District Board, he/she shall become a new member, and shall be subject to the Constitution and By-Laws of the District Board.
Section 2. Transfer of Authority. When a member changes his/her residence, the Secretary of the first District Board shall notify the Secretary of the District Board, into whose jurisdiction the official is transferring, of such change.
Section 3. Members standing. Any official who is not in good standing as a member of a chartered board of the International Association of Approved Basketball Officials cannot be accepted as a transfer to another chartered board.
a. For the failure to comply with established authority or regulation of a member's Area, District or State Board, International Association or the Executive Committee, for the delinquency in the payment of dues, assessments or penalties, or for any other conduct conclusively established to be contrary to the best interests of IAABO or conduct which reflects discredit upon IAABO, a member may be expelled, suspended for not more than one year, placed on probation for not more than one year, and/or fined not more than a varsity game fee.
b. In order to continue to hold membership in any District Board, a member must meet all of the attendance requirements of his/her District Board, and must attend a Fall Interpretation meeting presented by the State Board 32 Interpreter. The Executive Board may approve a substitute interpreter at any regularly scheduled meeting. If time and circumstances require, the Board 32 President and Supervisor of Officials may jointly approve a substitute interpreter. The penalty for not attending such a Fall Interpretation meeting shall be the loss of officiating privileges for the season after December 31 of that season, unless this penalty is waived, for good cause, by the State Executive Board.
c. Any member may also be fined by the Executive Board, up to a maximum amount equal to a regular season varsity game rate, for each incident that forms a ground for discipline.
Section 2. In the event any official is assaulted or threatened by a player, a coach, or a school authority, that information must be reported to his/her District Board Secretary-Treasurer, and to the State Supervisor of Officials, within twenty-four (24) hours. The State Executive Board shall thereupon conduct a review to which the official and the player, the coach, and/or the school authority may be invited, with suitable advance notice, to present their positions with respect to the incident. If the State Executive Board, after such a review, finds that an assault or threatening action took place, members of Board 32 may be forbidden to work in any game in which the player, the coach, or the school authority is involved, for a period of up to 365 days. A member withholding this information, or officiating after having been informed of the Executive Board ruling, shall be appropriately disciplined.
Section 3. Appeal. Any member disciplined by the State Executive Board, or by any District Board, shall have the right to appeal. The appeal shall be made directly to the State Executive Board President no later than 15 calendar days after the receipt of the notification of the disciplinary action.
Section 4. Right of Hearing. A member subject to a disciplinary proceeding shall have the right to be heard in person, or by written statement or both, as he/she may choose. An appeal hearing shall be held no later than 30 days from the date of the receipt of the appeal by the President.
Section 5. Discipline Notice. When a member is suspended or expelled the District Board or State Executive Board shall notify all concerned that such member is no longer able to accept assignments or officiate as a member of this Association. No member shall knowingly officiate with a suspended or expelled member.
Section 6. Dual Members. In the event an official, who is a member of two separate District Boards, is disciplined by one District Board, that disciplinary action shall be honored, and followed, by the other District Board.
Section 7. Disciplinary Panels. Any disciplinary action taken directly by the State Executive Board shall be through a panel comprised of one representative of each District Board, each of whom shall be randomly chosen by the President. Any appeal from the panel's decision shall be to the balance of the Executive Board. All appeals from District Board actions shall be to the entire State Executive Board.
Basketball Games
Section 1. Suitable recognition. Members of the District Boards of the State Board who have been officials for 25 years shall be suitably recognized by the State Board through their District Board.
Section 2. Solicitation. No member of the State Board or of any District Board may solicit regular season basketball games.
Section 3. No member of any District Board shall accept any basketball game assignment after having accepted and confirmed a previous high school varsity basketball assignment, unless prior arrangements have been agreed to by the Assigner.
Section 1. Each District Board shall adopt a Constitution and By-Laws, and may establish operating policies, provided they are not in conflict with the Constitution and By-Laws of New Hampshire Board 32, and of the International Association of Approved Basketball Officials.
Section 2. Each District Board will make available, for informational purposes only, a copy of its current Constitution and By-Laws, and any operating policies, to the State Secretary-Treasurer and to each other District Board Secretary-Treasurer.
Section 3. Each District Board will specify the rules and regulations its members must comply with, including, but not limited to, attendance requirements at interpretations, attendance requirements at business meetings, NHIAA registration requirements, election of representatives and officers, taking the annual test and payment of all dues and other fees.
Section 1. These By-Laws may be amended by a two-thirds vote of the duly accredited members, present at any regularly scheduled meeting or at any special meeting called for that purpose, provided, in the latter case, that written notice of the proposed amendment shall have been sent to all members at least fifteen days prior to the meeting. Amendments shall not be in conflict with the Constitution and By-Laws of IAABO.
